Court case highlights legal position on tooth whitening

A court case where a beautician has been fined for performing illegal tooth whitening serves to highlight the fact that only dentists such as Illume are qualified to carry out these procedures.

The Sheffield-based woman was prosecuted by the General Dental Council (GDC) after admitting that she is not a qualified dental professional, nor is she registered with the GDC which means that she cannot legally perform tooth whitening.

She was fined £700 and ordered to pay the full costs of £2,285.92 to the GDC.

Tim Rumney, practice owner and clinical director at Illume, says: “This case shows just how seriously both the GDC and the magistrates’ courts take the illegal practice of dentistry.

“The GDC’s role is to protect patients and work to maintain public confidence in the dental profession and this is achieved partly by regulating dental professionals, investigating and, where appropriate, prosecuting cases of illegal practice.

“I hope that this outcome will encourage clients and members of the wider community to ensure that they only have tooth whitening procedures carried out by a qualified dental professional who must be registered with the GDC.

“This case also highlights the dangers of undertaking training courses that claim to provide the necessary qualifications to carry out tooth whitening.

“In this case, the woman fined said she had undertaken a course in laser teeth-whitening, unaware that this would not then qualify her to practice,” he added.
